DWI vs. DUI Under Arkansas Law

Arkansas draws a clear line between DWI and DUI based on the driver’s age. DWI applies to drivers 21 and older with a blood alcohol concentration (BAC) of 0.08 percent or higher under Ark. Code § 5-65-103. DUI applies to drivers under 21 with a BAC between 0.02 and 0.08 percent. A driver under 21 who registers 0.08 percent or higher faces the adult DWI statute, not the DUI statute.

You don’t have to be moving for a charge to apply. Arkansas law covers being in “actual physical control” of a vehicle. A running engine or motion isn’t required. The law also extends beyond cars to watercraft and aircraft, and it applies on private property as well as public roads.

Arkansas’s implied consent law means that by driving in the state, you’ve automatically consented to a chemical test (breath, blood, or urine) if an officer suspects DWI under Ark. Code § 5-65-202. Refusing the test carries its own consequences, separate from the criminal charge.

Arkansas DWI Penalties & the 7-Day Hearing Deadline

Penalties increase sharply with each offense, and one deadline can’t be missed: you have 7 days from the date of arrest to request an administrative hearing to contest your license suspension. Missing that window means automatic suspension. At arrest, the officer may seize your license and issue a 30-day temporary permit while the suspension clock runs.

Penalties by offense tier:

  • First offense (misdemeanor): 24 hours to 1 year in jail; $150 to $1,000 in fines plus at least $300 in court costs; 6-month license suspension
  • Second offense within 5 years (misdemeanor): 7 days to 1 year in jail; $400 to $3,000 in fines plus at least $300 in court costs; 24-month license suspension
  • Third offense within 5 years (misdemeanor): 90 days to 1 year in jail; $900 to $5,000 in fines plus at least $300 in court costs; 30-month license suspension
  • Fourth offense (felony): 1 to 6 years in prison; $900 to $5,000 in fines; 4-year license revocation with no restricted license available (Ark. Code §§ 5-65-104, 5-65-118)

If a passenger under 16 was in the vehicle, mandatory minimum jail time increases at every tier. Beyond the sentence itself, a conviction requires completing a state drug and alcohol education program, attending a Victim Impact Panel class, installing an ignition interlock device for the duration of the suspension, and paying a $150 reinstatement fee to Driver Control. SR-22 insurance filings and elevated premiums typically follow for three to five years, and a conviction can complicate employment background checks and professional licensing.
